PHMSA Releases Pre–Publication Rule on International Harmonization (HM–215j)
On December 30, 2008, the Pipeline and Hazardous Materials Safety Administration (PHMSA) released the final version of a rule authorizing immediate voluntary compliance with the 2009 changes to the International Maritime Dangerous Goods Code, the International Civil Aviation Organization’s Technical Instructions for the Safe Transport of Dangerous Goods by Air, the United Nations Recommendations on the Transport of Dangerous Goods, and subsection 4.18(5) of Amendment 6 to Canada’s Transportation of Dangerous Goods Regulations, pertaining to placarding of anhydrous ammonia. This harmonization is part of the ongoing effort to increase the uniformity and efficiency of the domestic regulations with the international standards for shipping hazardous materials.
Specific amendments and clarifications concerning batteries and battery–powered devices have been included. Directly related to the International Civil Aviation Organization’s Technical Instructions, the final rule clarifies requirements for transporting electrical devices, including batteries and battery–powered devices and the packaging and handling of batteries and battery–powered devices. The focus here is on the more stringent safety precautions needed in shipping batteries, especially in air commerce.

The rule will become effective 30 days from the date it appears in the Federal Register. Voluntary compliance is authorized as of January 1, 2009.
